What is the UK Scale-Up Visa?

As of 22 August 2022, the UK’s new Scale-Up visa came into effect, aiming to offer easier and cheaper ways to bring new employees into the country, specifically in the tech sector. The UK Government website contains a list of eligible occupations.

What businesses qualify?

The new visa, which will last for 2 years and can be extended, is only available when applying to companies that can prove staff and financial growth in the 3 years prior to application. These fast-growing UK businesses are often referred to as scale-up businesses, hence the title of the visa.

What applicants can apply?

To qualify for the Scale-Up visa, according to the UK Government website, applicants must:

have a confirmed job offer to work for an approved scale-up business for at least 6 monthshave a ‘certificate of sponsorship’ from your employer with information about the role you’ve been offered in the UKhave a job offer to do a job that’s on the list of eligible occupationsbe paid a minimum salary in your new job

Applicants must also be able to speak, write, and read English.

How long is this visa valid?

Applicants can stay in the UK for 2 years on this visa, but this timeframe can be extended. When the visa is expiring, you can extend it as many times as you like in 3-year increments if you still meet all the requirements of the visa. Applicants may also change their employer while on the first 6 months of the visa but will have to apply to update their visa if they chose to do so. This is a really big deal and makes this visa incredibly unique as this is usually not possible with most other UK visas.

After 6 months on this visa, applicants can continue working their job, change or stop doing their job, or become self-employed, all without updating their visa.

The application process

All applications can be done online and can include your partner or children when applying if they are also eligible as dependants. Their visa will end the same date as your own visa.

Applicants can apply for their visa up to 3 months prior to their first day of work for the company and must provide the relevant identity and work documents required for the visa.

The decision process for this visa is 3 weeks for those outside of the UK.
